August 2025 in review: 340B rebate fight, BCBS settlement, Epic’s AI push

Hospitals challenged the timeline for a federal 340B rebate pilot, a court approved the Blue Cross Blue Shield provider settlement, and Epic laid out its AI roadmap.
August was quieter in Washington, but three developments carry real financial and operational weight: a change in how some 340B savings would flow, a large antitrust payout to providers, and a clear signal about where AI capabilities in the EHR are headed.
340B rebate pilot draws hospital pushback
HHS has announced a limited pilot letting drugmakers replace upfront 340B discounts with after-the-fact rebates. The pilot covers the 10 drugs on Medicare’s first negotiated-price list and is set to start January 1, 2026. Comments were due September 8, manufacturer applications September 15, and approvals October 15.
In mid-August, seven hospital and provider groups asked HRSA to extend those deadlines, arguing that a one-week gap between comments and applications left no room for real review. Their larger concern is cash flow: under a rebate model, covered entities pay full price first and wait to be repaid, which strains safety-net hospitals with thin liquidity.
Court approves $2.8 billion BCBS provider settlement
On August 19 a federal court gave final approval to the $2.8 billion settlement resolving provider antitrust claims against Blue Cross Blue Shield companies. The class covers hospitals, physician practices and other providers that treated BCBS members between July 2008 and October 2024. About $1.78 billion is designated for facilities and $152 million for professionals. The deal also includes commitments on claims processing, provider communication and contracting. Nearly 6,500 providers opted out and are pursuing their own suits.
Finance teams should confirm that claims have been filed for every eligible entity and track how the nonmonetary commitments show up in day-to-day dealings with local Blue plans.
Epic outlines its AI roadmap
At its users group meeting, Epic said it has more than 160 AI projects underway. New tools include Art, an ambient charting assistant built with Microsoft and expected in limited release in early 2026; Emmie, a patient-facing assistant for scheduling and visit preparation; and Penny, aimed at coding and denial appeals. Epic also previewed Cosmos AI, predictive models trained on Epic’s Cosmos data set of roughly 300 million patient records, along with an enterprise resource planning suite for workforce, supply chain and finance.
For Epic customers, the practical question is whether to keep paying for third-party scribes and revenue cycle tools or wait for native features. That decision belongs in contract renewal planning now.
Executive takeaway: Stress-test 340B cash flow under a rebate model, verify your BCBS settlement claims, and review point-solution AI contracts against Epic's announced timelines before renewing.
